Use of the portrait-painting.com website (www.portrait-painting.com) - a division of the company Portrait Painting, or any of its services implies acceptance of these Terms and Conditions. To protect your own interests please read our Terms and Conditions carefully before ordering which indicates accepting them. If you are uncertain as to your rights or want any explanation about our Terms and Conditions please email info@portrait-painting.com. We invite you to print these Terms and Conditions or we can email them to you upon request. These Terms and Conditions contain the whole of our agreement relating to your purchase including information about our pricing and contact details. They cannot be varied unless an approval to do so is signed by a Manager of the Company Portrait Painting (a Limited Liability Company). If any part of these Terms and Conditions are declared void for unfairness pursuant to the Unfair Terms in Consumer Contract Regulations 1999, or any other reason, the remaining contract shall continue to bind the parties excluding the specific unfair terms exception(s).

Resale or Third Party Supply

Even without a prior written agreement all goods supplied by Portrait Painting are for personal use and permitted for re-sale. We reserve the right to refuse to supply any person or company. If you are interested in re-selling our products in larger scale, please contact us in advance in order to become our affiliate.

Delivery Policy

All our products are physical products shipped via different mail services depending on your location and product details. Shipping can take up to 14 business days, however, usually required only 3-7 business days. We periodically update our FAQ section for more accurate details in regards to shipping. If we expect the delivery to take longer we will notify you of any delays. The customer will be requested to provide billing and shipping address details during the ordering process. Portrait Painting will initiate the shipping to the shipping address (not the billing address), and the customer is liable to provide correct address details and to be available for delivery (signatures are generally required). We will not be held responsible or offer any form of refund for delays in the delivery of the products as this is due to a third party and is out of our control. If there is a delay in making the final balance payment or responding to email communication within a 24 hour period then this will increase the expected delivery timeframe and customers should take this into consideration when expecting delivery of their painting. We estimate that the total turnaround time from start to finish is on average 7 – 21 business days, but could be much longer. No dates are guarantee. We will use all reasonable endeavors to adhere to the delivery times set out, but please note these are not guaranteed. If you would like to receive your painting quicker than the stated delivery timeframe please contact us in advance to see if we are able to assist you with this request. If the packaging of the painting arrives damaged please check the painting at the time of delivery. If the painting is damaged please contact the courier company directly and obtain a complaint reference. Please also notify us within forty eight hours of receiving the portrait. A signature is required in order to receive the product, therefore, we are unable to deliver to P.O. Boxes. 

Framed Paintings

If you require your painting to be framed please note you will need to allow an additional 2-4 business days for delivery.  

Frames published on the website are sample photos, delivered frames might differ slightly depending on Portrait Painting's actual frame stock.


In case you require modifications to your painting after receiving the initial pre-view an additional 2-4 business days will be added to the normal delivery timeframe as stated under section “Delivery”. 

The customer can require up to 5 modifications after receiving the preview of the painting. After the 5th modification required we consider the order as cancelled.

Payment Methods

You can place your order using secure encryption (the Internet standard for secure transactions). Our secure payment service providers are PayPal, Stripe and Quickbooks. Please review the website www.paypal.com, www.quickbooks.intuit.com and www.stripe.com for detailed information. All of our payment and purchase options are 100% secure for our customers. Portrait-painting.com intends to provide you with the safest and most secure shopping experience possible. Since offerings and technologies change, we reserve the right to change, modify, add, or remove options of our website at any time without prior notice. 

Please note that after receiving a payment request for your approved portrait the payment will need to be made within seven days. Failure to do so will result in a storage fee of $1.00 per day.

Cancellation of Order & Refund Policy:

It is not permitted for the customer to submit new photos after the painting process has begun. Once you have received your initial preview photo and this has been approved it is not possible to cancel your order at this stage. No refunds will be offered if the received portrait is different from the agreed preview this is due to camera, screen resolution and light effects. Our products are all custom hand made as per customer's specification. Deposits are generally refundable. However in cases where the cancellation is a result of the customer`s change of heart and not related to the performance of our artists or our customer service team, deposits are non-refundable. The sale is final. Certain card issuing banks may charge you an "International Service Fee" depending on your location, regardless of whether or not a currency conversion is involved. This additional charge is not made by Portrait Painting or its payment processors, but is made entirely at the discretion of your card issuing bank. We can therefore not refund such charges as they are not due to us. Please, contact your bank in such cases and consider filing a complaint. Our liability is limited to the amount you paid. A painting received by a customer can be returned for a full refund without questions asked, however we will not pay for return shipping cost.

We will not sell or pass the information we collect on to any third parties. We will use the contact information provided by you via the website www.portrait-painting.com or via email to communicate with you by email or phone. You also agree to received information and updates about your order, and, about special promotions we run. In this section we refer to "personally identifiable information", which is information that enables us to identify you, such as your email address, phone number, name, and postal address. Like many e-commerce web sites Portrait-Painting.com works with PayPal and Stripe which are 100% secure online payment service provider. Our chosen partners are securely managing all customer data in accordance with consumer data protection legislation. The website uses following cookies: We are using Google Analytics. This cookie allows us to see information on user website activities, including, but not limited to page views, source and time spend on website. The information is depersonalized and is displayed as numbers, meaning it cannot be tracked back to individuals. This will help to protect your privacy. Using Google Analytics we can see what content is popular, and strive to give you more of the things you enjoy reading and watching. By using Google Ads / Bing Ads /Yahoo Ads tracking codes we are able to see which of our ads convert into orders. This allows us to make better use of our paid search budget. We use remarketing codes to log when users view specific pages, allowing us to provide targeted advertising in the future. Customers ordering on this website agreeing on receiving in future our newsletters and promotional emails. By using portrait-painting.com and placing an order customers agree to have their completed products displayed on our website and Facebook page, unless we receive written instructions not to use the images and finalized products. By using portrait-painting.com and placing an order customers agree to have their company names and logos displayed in the samples section of our website, unless we receive written instructions not to use them.

General Terms 

www.portrait-painting.com will make every effort to ensure that the website and other services are available continuously but reserves the right to modify, suspend, or discontinue all or any part at any time with or without notice. Unless specifically exempted any new features, services, or software applications introduced shall be subject to these Terms and Conditions. We reserve the right to modify or replace these Terms and Conditions at any time. Any change shall be effective immediately it appears on the site. Each time you use the service you are deemed to have accepted any such change. We accept no liability to the fullest extent permitted by law for the accuracy of information contained on the website which may contain technical inaccuracies or typographical errors. However this provision does not affect your statutory rights and remedies. In no circumstances will Portrait-Painting.com, the owner of this domain (www.portrait-painting.com) be liable for any loss or damages, whether direct, or consequential arising out of: (a) your use of Portrait Painting site, services, or your inability to do so; (b) your reliance on any content and/or: (c) goods and services in any way associated with the site and services. (d) Taxes and duties which maybe be due in your state or country. We will not be liable to you for any loss or damage caused by us, our managers, our employees, our agents, the owner of this domain, in circumstances where: (a) there is no breach of duty of care owed to you by us or by any of our manager, our employees or agents; (b) such loss or damage is not a reasonably foreseeable result of any such breach; (c) any increase in loss or damage results from breach by you of any of these Terms and Conditions; (d) such loss or damage relates to any business or non-consumer loss or damage including, without limitation lost data, lost profits, and business interruptions. As also mentioned in the FAQ page, we do hire worldwide portrait artists who directly send the artwork to our customers. It is up to the artist's obligations to declare the value of the parcel. We see our role as broker between the artist and the customer. Our portraits are painted in P.R.C. and shipped from this location. Portrait Painting is a limited liability company, and all possible liabilities are limited to the company's initial limited equity paid via Member contributions, and the Members and Managers of the company are held free of personal liability as per the laws of the State Nevada. We do not accept any responsibility for items held or delayed by customs. We deliver to 40 countries around the world, and we are unable to keep track with any local import regulation. We will pay sales taxes on behalf of our customers for orders shipping to Nevada. All other customers in the United States are required to pay any sales or use tax required by the laws of their US States. All paintings are made to order and are custom made. We will send you a photo of the completed painting for your approval. A painting received by the customer can be returned against a full refund. However, the painting needs to be shipped by the customer not later than 14 days after the receipt date. Portrait Painting will not refund the return shipping costs. When placing your order, a 10% down payment will be requested. After the portrait-painting.com's customer has accepted the preview photo of the painting, the balance will be charged. It is agreed, that balance payments have to be initiated within 24 hours after the customer accepted the completed painting. The painting will only be shipped after the balance and shipping fees are received. We reserve the right to alter prices for new orders without prior notice. Prices for orders in progress will not be altered. 


All images on our site are either licensed or in the public domain because their copyright has expired. This applies to the United States, Canada, the European Union and those countries with a copyright term of life of the author plus 50 -70 years. However, mistakes do happen. If you find any content on this website that you believe to be under copyright protection, please contact us immediately and it will be removed. In addition, faithful reproductions of two-dimensional original works cannot attract copyright in the U.S. according to the rule in Bridgeman Art Library vs. Corel Corp. 

For all portrait paintings as well as paintings on request customers are both responsible and liable for the images they upload on our website or send via email. Customers are required to verify that they hold the copyrights of the images provided to us, and we assume permission to use those images for the creation of the paintings. We will not be liable for any paintings www.portrait-painting.com paints derivative works on customers' behalf based on photographs provided by the customer. By ordering, customers permit us to use the images they upload and images of the final product on our websites and Facebook pages, however, customers can cancel this permission anytime in writing, and we will take down such images within a reasonable period of time. Reproductions will differ in size from the originals, and this product type will not be signed with the name of the original artist. 


Our paintings are not photographic reproductions and might differ from the original in size, signature, brushstrokes and other details. Responsibility to ensure that the image is in the public domain, use is within fair use provisions or that any copyright permissions required have been granted remains with the customer.
